Petitioner seeks bail in a case registered for the offences punishable under Sections 395, 412 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner is in custody since 30.05.2014. Earlier prayer for bail of the petitioner was refused on 08.01.2015 by this Court in Cr. Misc. No. 431 of 2015 as some looted jewellery was recovered from the possession of the petitioner and subsequently identified in the Test Identification Parade and the trial court was directed to expedite the trial. Submission of the petitioner is that up-till-now only one witness has been examined in this case. Considering the period already undergone by the

No.14176 of 2017 (4) dt.03-05-2017 2/2 petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VI, Bhojpur at Ara/successor Court in connection with S.Tr. No. 26 of 2016 arising out of Piro Police Station Case No. 146 of 2014, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
