Petitioner is an accused in a case registered for offence under section 364,414 and 34 IPC.

Learned counsel for the petitioner submits that on confessional statement of co-accused the petitioner has been implicated in this case, though there is no recovery of any incriminating article from his possession. Petitioner has not been put on TI parade and that the victim in the deposition has not said anything about the petitioner. Similarly situated co-accused Kundar Kumar has already been granted bail vide order dated 18.1.2018, passed in Cr Misc No.2443 of 2018. Prior to the lodging of the instant case, the petitioner is accrued in two other cases as have been detailed in paragraph 3 of the bail

Patna High Court Cr.Misc. No.18205 of 2018 (3) dt.04-05-2018 application, in which he is already on bail. Petitioner is in custody since 2.1.2018.

Considering the aforesaid submissions, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate IV, Jehanabad in Hulasganj Police Station Case No. 75 of 2016 on the following conditions:- One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner and The Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
