The petitioner seeks bail in connection with Turkaulia (Banjariya) P.S. Case No. 174 of 2013 registered under Sections 379, 411/34 of the Indian Penal Code.

The allegation of informant is that when he was coming from Raxaul to Bargania on loading the bundles of clothes on trucki, some persons managed to throw the one bundle of clothes. When the informant came to know about lifting one bundle of clothes, he started search then Kamlesh Sahani and Singeshar Sahani were found missing with the said clothes and they confessed guilt and some clothes were found in the house of

Submission is that the petitioner has falsely been implicated in this case on the basis of confession of the co-accused showing recovery of some clothes to his house. The petitioner is in custody since 20.2.2017.

Having regard to the facts and circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., XII, Motihari, East Champaran in connection with Turkaulia (Banjariya) P.S.
