JUSTICE ARUN KUMAR ORAL ORDER 29-06-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 31.3.2017, seeks bail in Kotwali PS Case No. 137 of 2017 registered under Sections 420 and 379 of the IPC.
The allegation in brief is that Laptop and other articles kept in the vehicle of the informant was stolen by the unknown persons, later on during investigation the petitioner was apprehended on the basis of CCTV footage as his act was captured. Learned Counsel for the petitioner submits that the stolen articles have not been recovered from his possession and charge has been framed in this case.
Whereas learned Counsel for the State submits that in the CCTV footage act of the petitioner was captured. Having considered the said facts and circumstances, the prayer for bail of the petitioner is presently rejected. The trial court is directed to expedite the trial and preferably conclude the same within a period of four months, if the trial does not conclude the petitioner may renew his prayer for bail.
