2. The instant petition has been filed against the order dated 23.03.2024 passed by learned Additional Principal Judge, Family Court, Patna in Guardianship Case No. 39 of 2018, whereby and whereunder the application filed by the petitioner under Order VII Rule 11(a) and (d) r/w 1(f) and Section 151 of the Code of Civil Procedure read with Section 9 of the Guardian and Wards Act has been rejected. Such an order is assailable under Section 115 of the Code of Civil Procedure and could not be entertained in Civil Miscellaneous Jurisdiction under Article
Patna High Court C.Misc. No.633 of 2024(2) dt.09-09-2024 2/2 227 of the Constitution of Indian.
3. Faced with the situation, learned counsel for the petitioner seeks permission to convert the present petition into a Civil Revision Petition.
4. Permission is accorded.
5. Learned counsel for the petitioner is directed to convert the present petition into a Civil Revision Petition within two weeks.
6. Office is directed to extend all cooperation towards conversion.
