Petitioner seeks bail in a case registered under sections 376, 302, 201/34 of the Indian Penal Code.

Petitioner is not named in the first information report but in course of investigation, statements of one Alok Singh and the informant were recorded under section 164 Cr.P.C after six months of the alleged occurrence and the informant as well as the above stated witness disclosed that on the basis of suspicion, one Biro Singh was interrogated and the aforesaid Biro Singh accepted that four persons committed rape and murder of the deceased. The above stated witness Alok Singh as well as the informant disclosed against the petitioner that he as well as some other had given threat to them. Moreover, co- accused Lal Bahadur Singh and two others having more or less similar allegation have already been granted

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Addl. Sessions Judge III, Naugachia in Sessions Trial no. 366/2016 arising out of Gopalpur P.S. Case no. 99/2012.
