JUSTICE SUDHIR SINGH ORAL ORDER 04-10-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 409,420, 467 and 468 of the Indian Penal Code. The Manager of SKS Micro Finance Limited instituted the FIR against the petitioner alleging that the petitioner, afer verification of the records, was found to have embezzled huge amount of the company which provided to give loan to the loanee. He also did not deposit the collection made from the customers. It has been submitted on behalf of the petitioner that the petitioner is in custody since 13.05.2016. Charge sheet has been submitted in this case.

The petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner happens to be the Field Officer in a private banking. No wrongful gain has been made by the petitioner. He was simply an employee of non banking finance company. It is further submitted that the petitioner is ready to deposit an amount of Rs.

On behalf of the State, it is submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances of the case, the petitioner is directed to deposit an amount of Rs. 1 lac in the court below within three months, which shall be subject to final disposal of the case.

Let, above named petitioner, be released on provisional bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Munger in connection with Kotwali P.S.Case No. 197 of 2015.

The entire amount shall be deposited by the petitioner within a period of three months from the date of release from jail. Once the entire amount has been deposited in the court below, the provisional bail of the petitioner shall be confirmed by the court below itself. If the said amount is not deposited within the stipulated period, the court below will be at liberty to cancel the provisional bail granted to the petitioner. (Sudhir Singh, J) singh/- U T
