JUSTICE ARUN KUMAR ORAL ORDER 19-06-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Laukaha P.S.Case No. 48 of 2017 registered under Section 394 of the Indian penal Code.

Submission is that FIR is against unknown and so far allegation of committing theft in the house of the informant, neither any incriminating materiel has been recovered from the possession of the petitioner nor he was put on TIP, except disclosure of his name in the confessional statement of coaccused, there is no other material against him and has been in custody since 17.10.2017.

Having considered the aforesaid facts and circumstances, petitioner, namely, Umesh Kumar Mehta @ Umesh Kumar Mahto, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each

Patna High Court Cr.Misc. No.18512 of 2018(3) dt.19-06-2018 2/2 to the satisfaction of the learned ACJM, Jhanjharpur, Madhubani in connection with Laukaha P.S. Case No. 48 of 2017 with condition that one of the bailor must be his close family member. Petitioner shall remain physically present on each and every date during trial and in case of failure on two consecutive dates without any reasonable cause, his bail bond shall be liable to be cancelled.
