Petitioner seeks bail in a case registered for the offences punishable under Sections 420,120(B)of the Indian Penal Code and 30(a) of Bihar Prohibition and Excise Act, 2016.

Petitioner is owner of the Bolero vehicle on which liquor was being loaded, after unloading the same from a truck. 99 liters of liquor was recovered from the Bolero vehicle. Petitioner has got no criminal antecedent.

Submission is that some other co-accused have been allowed anticipatory bail by a Coordinate Bench of this Court vide Annexure-1.

No.36232 of 2019(2) dt.10-06-2019 2/2 Considering the nature of allegation and material available, let the petitioner, above named, be released on bail after completion of investigation on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Excise Case No.943 of 2018 arising out of Karpi Police Station Case No.137 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
