JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-07-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Section 302 and other minor Sections of the Indian Penal Code. According to the prosecution case itself, it were coaccused Kare Mandal, Mahesh Mandal, Shambhu Mandal and Sonu Mandal who made indiscriminate firing as a result thereof deceased sustained fire arm injury and died then and there. So far as petitioners are concerned, no doubt, they are named in the first information report but there is only allegation that they made firing in air to terrorize the villagers and subsequently, disposed of
Patna High Court Cr.Misc. No.29905 of 2016 (2) dt.28-07-2016 2/2 the dead body of the deceased.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let petitioners above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M., Naugachia in connection with Bihpur P.S.
