JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-02-2021 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Saharghat P.S. Case No. 98 of 2020 for the offences under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition & Excise Act, 2016.

In the instant case, 90 litres of Nepali liquor has been seized from the motorcycle of the petitioner. Learned counsel appearing on behalf of the petitioner would submits that petitioner has no criminal antecedent and he is on custody since 21.08.2020.

Patna High Court CR. MISC. No.37187 of 2020(2) dt.02-02-2021 2/2 Considering the fact that petitioner has no criminal antecedent and the period of custody, this Court is inclined to grant bail to the petitioner, subject to deposit of cash of Rs. 25,000/-.

On deposit of cash of Rs. 25,000/- the petitioner, above named, shall be released on bail on furnishing bail bonds of Rs. 25,000/- (Rupees twenty five thousands) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cumSpecial Judge, Excise Act, Madhubani in connection with Saharghat P.S. Case No. 98 of 2020, G.R. No. 1003 of 2020.

The deposit of cash of Rs. 25,000/- shall abide by the final outcome of the present pending criminal case.
