JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-06-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 342, 341, 506 and 354B of the Indian Penal Code.

It is alleged that the informant went to ease out on 24.04.2015 at 7 PM when the petitioner took her to his house and striped her and also attempted to establish forceful physical relationship but on alarm being raised, the informant escaped from the scene.

It is submitted by learned counsel for the petitioner that the accusation has been levelled in the background of pending land dispute being Boundary Dispute Case No. 39 of 2013-14. For the occurrence of 24.03.2015 at 7 PM the

Patna High Court Cr.Misc. No.24996 of 2015 (2) dt.30-06-2015 2/2 FIR was lodged on 25.03.2015 at 2.30PM. The FIR does not suggest that the victim was subjected to any medical examination and the father and other family members of the victim are accused in Telhara P.S. Case No. 118 of 2014 registered under Sections 302 and 201/34 of the IPC for killing the mother of the informant. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Mahila P.S. Case No. 44 of 2015 pending in the court of learned 1st Addl. Sessions Judge Cum Special Judge, Nalanda at Biharsharif.

Accordingly, the application is disposed of.
