The petitioner seeks bail in Jhajha P.S. Case No. 16 of 2013 under Sections 25(1-B)A/26/35 of the Arms Act, Section 121/121A of the Indian Penal Code and Sections 16/17 of the U.A.P. Act.

The police raided the house of Lalan Yadav @ Lalo Yadav and thereafter the police also raided the house of the petitioner. From the house of the petitioner different books of Naxal literature and other articles for preparing the explosive were recovered.

It is submitted by learned counsel for the petitioner that petitioner was not arrested in the house. The petitioner is in jail since 15.08.2016 and similarly situated co-

Patna High Court Cr.Misc. No.14950 of 2017 (2) dt.19-04-2017 2/2 accused Lalan Yadav and Damodar Yadav have already been enlarged on bail. The petitioner has remained in jail for about eight months.

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Jamui in connection with U.A.P. Case No. 28 of 2015, arising out of Jhajha P.S. Case No. 16 of 2013.
