Petitioners seek bail in a case registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code.

Specific allegation of demand of motorcycle as dowry is against the husband of the deceased who died within seven years of her marriage in her matrimonial house in unnatural circumstances. However, there is general and omnibus nature of allegation against the petitioners also who are cousin father-in-law and wife of elder brother of the husband of the deceased. Petitioners are in custody since 23.02.2019. Investigation of the case is already complete. Learned counsel for the informant opposed the

Patna High Court CR. MISC. No.36056 of 2019(2) dt.04-06-2019 2/2 prayer for bail on the ground that husband of the deceased is still absconding and presumption of dowry death is there against the petitioners also.

Considering the general and omnibus nature of allegation against the petitioners and completion of investigation of the case, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Udwant Nagar Police Station Case No. 40 of 2019, subject to the condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
