JUSTICE RAKESH KUMAR ORAL ORDER 13-07-2015 Heard learned counsel for the petitioner, learned AC to GP No. 31 as well as learned counsel for the respondent no. 3. The present writ petition has been filed with a prayer to quash a proceeding i.e. Reference Case No. 9 of 2011. It is admitted fact that in Reference Case no final order has been passed. A plea has been taken by learned counsel for the petitioner that in continuation of Bi-partite Settlement, the matter was not required to be referred, and as such, Reference proceeding may be set aside.
The court is of the opinion that unless any order is passed in the Reference Case, the petitioner has got no cause of action to invoke the writ jurisdiction. If the petitioner feels
Patna High Court CWJC No.10720 of 2011 (4) dt.13-07-2015 2/2 aggrieved with the Reference, he would be at liberty to raise the objection before the appropriate authority.
The writ petition stands disposed of.
