JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 22-01-2015 Heard learned counsel for the Petitioner and the State.

The petitioner, who is a juvenile, is an accused in Palanwa P.S. Case No. 94 of 2013 for the offences under Section 395 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. and there is no material against him. He further submits that no incriminating materials has been recovered from the possession of the petitioner. He further submits that there is no cogent material against the petitioner save and except the confessional statement of co-accused. In the facts and circumstances of the case, the petitioner is directed to be released on bail on furnishing bail bond of Rs.5,000/- (Five thousand) with two sureties of the like amount

Patna High Court CR. REV. No.1033 of 2014 (2) dt.22-01-2015 2 / 2 each to the satisfaction of Juvenile Justice Board, Motihari in connection with Trial No. 825 of 2014, arising out of Palanwa P.S. case No. 94 of 2013 with the condition that the father of the petitioner would file an affidavit in the court below stating that he would take care of his son.
