The petitioner apprehends his arrest in a case under Section 461, 379 of the Indian Penal Code.
The petitioner is not named in the FIR. The name of petitioner figured during the course of investigation. The informant is co-villager of the petitioner.
It appears that name of petitioner figured in the case in the statement of Raja Ram Sharma, Rameshwar Mahto and Mukesh Kumar @ Kallu Kumar but no stolen article was recovered from the possession of petitioner. The petitioner has already been enlarged on anticipatory bail in Daudpur P.S. case No. 27/ 2012 and Daudpur P.S. case No. 41/2012.
Patna High Court Cr.Misc. No.25439 of 2015 (2) dt.14-07-2015 2/2 Considering the facts aforesaid and the nature of allegations made against the petitioner and the fact that no tangible material was found against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri P. K. Choudhary, learned Judicial Magistrate, 1st class, Saran, Chapra in Daudpur P.S. Case No. 40 of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
