The petitioner seeks bail in a case instituted for the offences under Sections 147, 148, 149, 341, 323, 307, 427, 379, 436, 337, 353 and 504 of the Indian Penal Code. The prosecution case in short is that the accused persons assaulted the informant and other personnel posted at the hospital due to which they sustained injuries and caused heavy loss to the hospital.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 10.4.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been submitted in the present case. Altogether 40 persons have been

Patna High Court CR. MISC. No.38224 of 2019(2) dt.25-06-2019 2/2 named in the F.I.R.. The petitioner is not named in the F.I.R. General and omnibus allegation has been made against the petitioner. Other co-accused has been granted bail vide Annexure-2 to this application.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Rajpur P.S. Case No. 62 of 2019.
