JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-06-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 17.7.2017 passed in Cr.Misc.No. 26661 of 2017 with an observation to expedite the trial and conclude the same within a period of seven months with liberty to the petitioner to renew his prayer for bail if trial is not concluded. Submission of learned counsel for the petitioner is that till date no substantive progress has been made in trial and petitioner is in custody since 12.4.2017. It has further been submitted that petitioner is aged 66 years.
Heard learned APP and perused the report. From perusal of report it appears that in this case informant has been examined and process has been issued and trial will be concluded as soon as possible.
Patna High Court Cr.Misc. No.22214 of 2018 (4) dt.20-06-2018 2/2 In such view of the matter, I am not inclined to grant bail to the petitioner.
However, if the trial is not concluded within a further period of four months from the receipt of this order, without any laches on the part of the petitioner, learned trial court shall release the petitioner on bail to its own satisfaction. With the above observation, this application is disposed of.
