The petitioner is languishing in custody for the offences punishable under Sections 147/148/149/341/ 323 / 307/379/427/354A/354B/353/120B/504 of the Indian Penal Code.

Although petitioner and others are named in the FIR but no specific overt-act has been attributed against the petitioner. Moreover, having identical allegation co-accused Dinesh Rai and others have already been granted privilege of bail by a coordinate Bench of this Court vide order dated 23.05.2019 passed in Cr. Misc. No.33578 of 2019. Considering the aforesaid facts, let the petitioner,

Patna High Court CR. MISC. No.36089 of 2019(2) dt.04-06-2019 2/2 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Rajpur P.S. Case No.64 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below having immovable property in his name.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Mkr./- U T
