JUSTICE SHIVAJI PANDEY ORAL ORDER 19-10-2016 Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel for the State. In this case, the petitioner is seeking regular bail in connection with Marachi P.S. Case No.124 of 2015, registered for the offence punishable under Sections 364, 302 & 201/34 of the Indian Penal Code.

It is a case of last seen, whereafter the dead body of the husband of the informant, in two pieces, was found in a railway track. Subsequently, the dead body of the son of the informant was recovered from a well and with respect to that one case being Marachi P.S. Case No.125 of 2015 was lodged. Learned counsel for the petitioner submits that save and except the last seen, there is no material connecting the

Patna High Court Cr.Misc. No.27531 of 2016 (6) dt.19-10-2016 2/2 petitioner with the incident for which the petitioner has been put behind the bar.

Learned counsel for the informant has produced the order passed in Criminal Miscellaneous Nos.25245 of 2016 which relates to death of the son of the informant, whereby the Court has not bail to accused-Vikesh Singh. He also produced the order passed in Criminal Miscellaneous No.18290 of 2016 with respect to Marachi P.S. Case No.125 of 2015 which also relates to death of the son of the informant, in which myself has rejected the bail application of accused-Pintu Tanti. In such view of the matter, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, Trial Court is directed to expedite the trail and conclude the same without unnecessary delay. (Shivaji Pandey, J) pawan/- U T
