The petitioner is in custody since 22.01.2018 in connection with Ahiyapur P.S. Case No. 1068 of 2017 for the offence registered under Sections 399, 402 of the Indian Penal Code and Section 25 (1-b) a, 26 (ii), 35 of the Arms Act and Section 8 and 20(b)(ii) of the Narcotic Drugs and Psychotropic Substance Act.

Learned counsel for the petitioner submits that admittedly, the alleged recovery was made from one Kislay Singh and not from this petitioner. The only recoveries which were made were of one country-made pistol and three live cartridges. Considering the period of custody and there has been no recovery of any substance which could invoke the provisions of

Case No. 1068 of 2017.
