JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-07-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Complaint Case No. 3344 of 2012 registered for the offences punishable under Section 406, 384 and 506 of the Indian Penal Code.

The accusation against the petitioner, who is Mukhiya, is that he took Rs. 10,000/- from the complainant on the pretext to provide pass book of Indra Awas to the B.D.O., but submission on behalf of the petitioner is that one Masihan Khatoon had filed complaint case against the then Mukhiya in the year 2008 and petitioner was shown as witness in the aforesaid case and deposed

Patna High Court Cr.Misc. No.47426 of 2014 (5) dt.31-07-2015 2/2 against Ex-Mukhiya, who, later on, managed the present complaint and got instituted this present case. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Chapra in Complaint Case No. 3344 of 2012 , subject to condition as laid down under Section 438(2) of the Cr.P.C.
