2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 394 and 302 of the Indian Penal Code and Section 27 of the Arms Act.

3. The case of the prosecution, in brief, is that unknown miscreants allegedly looted a sum of Rs. 26,700/- from a petrol pump. The FIR was lodged against unknown miscreants. During the course of investigation, one co-accused, namely, Pritam Kumar @ Jaggu @ Jaggu Sahni @ Pritam has given his confessional statement and the name of this petitioner has surfaced on the basis of the said confessional statement.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that

No.38095 of 2025(3) dt.02-09-2025 2/2 nothing has been recovered from his conscious possession It is further submitted that the said co-accused, Pritam Kumar @ Jaggu @ Jaggu sahni @ Pritam, on whose confessional statement name of the petitioner has figured, has been extended the privilege of bail vide order dated 18.01.2024 passed in Cr. Misc. No. 900 of 2024. It is also submitted that the petitioner has not been put on Test Identification Parade (TIP). Moreover, the petitioner is languishing in judicial custody since 21.02.2025.

5. Learned APP appearing for the State has opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Dumariyaghat P.S. Case No. 180 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari.
