Petitioner apprehends his arrest in a case registered for the offence punishable under Section 436 and some other minor Sections of the Indian Penal Code.

As per the prosecution case, on 29.03.2021 at 3 PM this petitioner along with other accused persons came to the house of informant armed with rifle and began to abuse. It is further alleged that petitioner set the thatched house of informant on fire by using match box as a result of which 80 bags of rice and 80 maunds of rice got burnt. It is submitted that earlier dacoity had taken in the house of petitioner in which aunt of the petitioner was killed by dacoits and the uncle of the husband of informant was accused in that case and due to that grudge and enmity this false case has been lodged by the informant after setting her house on fire. Learned counsel appearing for the State and the informant opposed the prayer for anticipatory bail. Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
