JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under section 47(a) of the Excise Act.

On recovery of country made liquor being transmitted through a vehicle the seizure was made. The prosecution report suggests that the petitioner was one of the drivers of the vehicle who escaped from the scene though it is submitted that one Pramod Kumar was the driver of the vehicle. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Let the learned court below consider the prayer for

Patna High Court Cr.Misc. No.23962 of 2015 (2) dt.09-07-2015 2/2 regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Excise Case No. 85 of 2014 pending in the court of learned C.J.M., Motihari, East Champaran.

This application is disposed of with the aforesaid observation/direction.
