JUSTICE SUDHIR SINGH ORAL ORDER 06-09-2016 A supplementary affidavit has been filed on behalf of the petitioner. The same may be kept on the record. Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 363 and 366A/34 of the I.P.C. The prosecution story, in brief, is that on 28.9.2015 the informant's daughter, namely, Shobha Kumari had gone to School for studying, she was kidnapped by the accused persons including the petitioner for the purpose of marriage or sale. It has been submitted on behalf of the petitioner that the petitioner is in custody since 12.4.2016 and the charge sheet has been submitted in the present case. The petitioner has got no
Patna High Court Cr.Misc. No.29542 of 2016 (3) dt.06-09-2016 2/2 criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Statement of the victim recorded under Section 164 Cr.P.C. has been brought on record by way of supplementary affidavit. The victim has stated that she has already got married to the co-accused, namely, Awadhesh Kumar Yadav @ Ravi Ji and they have been blessed with a child. There is no allegation against the petitioner by the victim. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 11, Motihari, East Champaran in connection with Kesariya P.S. case No.266 of 2015 (G.R. case No.5469 of 2015).
