Petitioner, already in custody since 25-05-2017 seeks bail in Dariyapur PS Case No. 129 of 2017 corresponding to Sessions Trial No. 632 of 2017 registered under Sections-304B/34 of the IPC.

Learned counsel for the petitioner submits that though the petitioner is husband but the allegation against him is general and omnibus in nature. It is alleged that his wife was done to death by poisoning but the postmortem report reveals the cause of death as asphyxia by throttling.

Learned counsel for the informant submits that the petitioner's wife killed by throttling who was always homicidal

Patna High Court Cr.Misc. No.16147 of 2018 (3) dt.11-05-2018 and in connection with further demand of dowry, she was murdered.

Having considered the aforesaid facts and circumstances, the cause of death as well as the nature of allegation, the prayer for bail of the petitioner is rejected. (Arun Kumar, J) A.K.V./- U T
