JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 17-03-2016 Petitioner filed the writ application for a direction upon the J P University to take steps for issuing a certificate of compliance for the University Grant Commission (Minimum Standard and Procedure for Award of Ph.D. Degree) Regulation, 2009.
The University has filed an affidavit, duly sworn by the Registrar and this is what is stated by them in para 5, which is reproduced herein below:
"5. That in this regard it is important to note here that as per the said statutes the first batch has been started since July 2014 in the
Patna High Court CWJC No.20490 of 2014 dt.17-03-2016 University for the Award of Ph.D. Degree under the UGC Regulation 2009. Further in this regard, it is important to note here that the petitioner has been registered in the University on 05.06.2010 for the award of Ph.D. Degree under old regulation and passed out from the University vide notification/memo no.C/2858 dated 04.01.2014. The said notification may be seen at Annexure-5 of the writ application."
In view of the stand of the University with the supporting notification, no direction in favour of the petitioner can be given. Writ application is dismissed.
