JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under section 384 of the Indian Penal Code.
The prosecution case is that the brother of the informant was abducted and extortion was demanded. Though the case was instituted in 2005 and charge sheet was submitted in 2007 declaring the petitioner an absconder.
It is submitted by learned counsel for the petitioner that father's name of the petitioner has been recorded as Janardan Singh whereas petitioner is the son of Rajdhari Singh hence no process was ever served upon the petitioner.
Patna High Court Cr.Misc. No.23933 of 2015 (2) dt.09-07-2015 2/2 Let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Chhatauni P.S. case No. 123 of 2005 pending in the court of learned C.J.M., East Champaran, Motihari.
This application is disposed of with the aforesaid observation/direction.
