JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-10-2016 Heard learned counsel for the petitioner as well as learned Additional P.P. for the State.

Petitioner happens to be the husband of the deceased and is languishing in jail custody since 31.03.2016. The marriage of the petitioner was solemnized with deceased in the year 2014 and deceased died within one year of her marriage. The informant claims that in the night of 24.07.2015 she got information that her daughter was killed by her in-laws as well as her husband and her dead body was thrown on the railway track to give the colour of accidental death. The postmortem report of deceased goes to show that almost all the fatal injuries were found on left part of the body of the deceased. The left side of face of deceased was found crushed.

No.30104 of 2016 (3) dt.20-10-2016 2/2 No doubt, the informant as well as her family members including some co-villagers stated that the deceased was killed by her in-laws as well as her husband but the investigating officer did not take pains even to go to the railway track where it is said that the dead body of the deceased was thrown. However, the dead body of the deceased was recovered in front of the house of the petitioner and explanation regarding the aforesaid recovery is that after the accident the dead body of the deceased was brought in front of house of the petitioner and that was the reason of recovery of dead body in front of house of the petitioner. The investigation against this petitioner has already been completed.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Sandeep Patel, Judicial MagistrateIst Class, Jehanabad in connection with Parasbigha P.S.Case No.69 of 2015.
