Petitioner seeks bail in a case registered for the offences punishable under Sections 395, 397 and 412 of the Indian Penal Code.

The FIR is against unknown relating to an occurrence of bank dacoity.

Submission is that some other co-accused were apprehended by the police while they were fleeing and they disclosed name of other co-culprit, including the petitioner, who has already been allowed bail by a Coordinate Bench of this Court.

Considering the fact that only material against the petitioner is the confessional statement of the co-accused as well

Patna High Court Cr.Misc. No.9506 of 2018 (5) dt.18-06-2018 2/2 as the fact that the petitioner is in custody since 13.12.2016, investigation of the case is already complete, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Benipatti Police Station Case No. 72 of 2012, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
