The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 406 of the Indian Penal Code.
Learned counsel for the petitioner submits that allegation as per FIR, informant stated in fardbeyan that driver of the informant has abducted the truck and later on somebody thrown away the said truck to Kodarma Ghati. The petitioner is not named in the FIR. The confessional statement of co-accused Birendra Kumar @ Prince has disclosed the involvement of the petitioner. There is no specific allegation against the petitioner. The co-accused has been granted anticipatory bail by the Coordinate Bench of this Hon'ble Court in Cr. Misc. 1660 of
Patna High Court CR. MISC. No.36462 of 2019(3) dt.14-08-2019 2/2 2019 dated 24.01.2019.
In the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Rajauli P.S. Case No. 22 of 2018 to the satisfaction of the learned Chief Judicial Magistrate, Nawada, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
