JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 47(a) of the Excise Act. 2000 liters of country made liquor were recovered from a breakdown vehicle when it is alleged that seeing the raiding party the petitioner and other miscreants escaped from the scene. It is submitted by the learned counsel for the petitioner that the petitioner is in no way connected with the vehicle. Statement to the aforesaid effect has been made in paragraph 11 of the petition. Statement has also been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. It is further submitted that co accused Panalal Sah has been granted

Patna High Court Cr.Misc. No.23968 of 2015 (2) dt.09-07-2015 2/2 anticipatory bail vide Cr. Misc. No. 3567 of 2014. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Motihari, East Champaran in connection with Excise Case No. 41 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
