The petitioner seeks bail in connection with Akbarpur P.S. Case No. 271 of 2020 dated 30.05.2020 instituted for the offence under Sections 25(1-b)a/26/35 of the Arms Act.

As the allegation in the FIR stands, from the house of the petitioner one country made pistol, one country made rifle, another rifle and many live and blank cartridges are said to have been recovered.

Learned counsel for the petitioner has submitted that out 15 accused persons, 14 of them have been granted bail by a Bench of this Court.

Apart from this, it has been submitted that though the recovery is stated to be from a house

Patna High Court CR. MISC. No.37040 of 2020(2) dt.02-02-2021 2/2 belonging to the petitioner but the facts remains that the house belongs to the maternal uncle of the petitioner. The petitioner is in custody since 30.05.2020. In the same transaction, one another case was lodged vide Akbarpur P.S. Case No. 270 of 2020 and that is the only other case apart from the present one in which the petitioner has been made accused.

Considering the aforestated facts, the petitioner is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Akbarpur P.S.
