JUSTICE SUDHIR SINGH ORAL ORDER 06-07-2015 The petitioner is apprehending his arrest in connection with Mahila PS case No. 33 /2014 for the offence under section 498A/34 of the Indian Penal Code and section 3/4 of the Dowry Prohibition Act.

Heard learned counsel for the petitioner and the State. The prosecution story, in brief, is that complainant was married to petitioner and thereafter she was leading conjugal life and has been blessed with one daughter. Thereafter the accused persons started demanding motor cycle and due to non-fulfillment of the demand they committed cruelty and torture on her person in various manner on various occasion and lastly she has been driven out from her matrimonial home along with her daughter.

No.23613 of 2015 (2) dt.06-07-2015 2/2 It is submitted on behalf of the petitioner that petitioner is ready to keep the complainant with all respect and dignity but the same is not acceptable to the complainant. It is further submitted that petitioner is ready to deposit an amount of Rs. 1500/- each month in the court below which shall be released in favour of the complainant.

On behalf of the State, it has been submitted that petitioner is named in the FIR.

Considering the aforesaid facts, it is directed that petitioner shall deposit a sum of Rs. 1500/- each month in the court below which shall be released in favour of the complainant. With the said condition, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sub-divisional Judicial Magistrate, Saharsa in connection with Mahila PS case No. 33C/2014, subject to condition as laid down under section 438(2) of the Cr.
