Petitioner apprehends his arrest in Town P.S. Case No.606 of 2008 instituted for the offence under Section(s) 341, 324, 307/34 Indian Penal Code pending in the Court of the Additional Sessions Judge, Fast Track Court No.3, Vaishali at Hajipur.
It has been submitted that petitioner is not Pintu Singh, rather, his name is Anand Kumar Singh, but police is after him. Therefore, he has apprehension of his arrest. The Sessions Judge has mentioned in the impugned order that the occurrence is of the year 2008 and the anticipatory bail application has been filed in the year 2017 i.e. after about nine years and, as such, the petitioner has no apprehension of his
Patna High Court Cr.Misc. No.17568 of 2017 (5) dt.03-01-2018 2/2 arrest for last nine years.
This Court is of the view that if petitioner is Anand Kumar Singh and not Pintu Singh, he may file necessary application before the police officials, who will hold proper enquiry in to the matter.
This Court is not inclined to entertain this anticipatory bail application.
Accordingly, application is dismissed.
