The present petition has been filed for grant of regular bail on behalf of the petitioners in connection with Special Case No. 3488 of 2019 arising out of Agamkuan P.S. Case No. 315 of 2019 registered for the offence punishable under Sections Sections 30(a), 38 and 41 of the Bihar Prohibition of Excise Act, 2016.

The allegation is regarding recovery of 240 litres of country made Mahua liquor from a tempo and the petitioners were apprehended while fleeing away from the tempo. The learned counsel for the petitioners submits that

No.42488 of 2019(3) dt.27-09-2019 2/2 the petitioners are not the owner of the tempo, as has been stated in paragraph no. 8 of the present petition and they have been falsely implicated in the present case. It is further submitted that the petitioners are having clean antecedent and are languishing in custody since 01.04.2019.

Having regard to the facts and circumstances of the present case, this Court deems it fit and proper to grant regular bail to the petitioners, above named, on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. 3488 of 2019 arising out of Agamkuan P.S.
