The petitioner is accused in connection with Birpur (Bhim Nagar O.P.) P.S. Case No. 273 of 2016, registered under Sections 399, 402 and 414 of the Indian Penal Code and Sections 25(1-B)A, 26 and 35 of the Arms Act and Section 38(i) of the Bihar Excise Act.

The accusation is of recovery of one country made loaded pistol along with two live cartridges and one bottle, containing 300 ml, of Nepali liquor from possession of the petitioner.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent and is in custody since

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Birpur (Supaul), in connection with Birpur (Bhim Nagar O.P.) P.S. Case No. 273 of 2016. Out of two sureties, one surety must be the close relative of the petitioner.
