04.08.2016 Heard learned counsel for the Petitioner as well as learned Additional Public Prosecutor for the State. The Petitioner seeks bail in a case registered for the offences under Section 47 of Bihar Excise Amendment Act.
Some utensils are said to be recovered from the house of the petitioner and it is claimed by the Informant that the aforesaid seized utensils were to be used for manufacturing the country-made liquor. Admittedly, no illegal liquor has been recovered from the house of the petitioner and even then he was arrested by the police and sent to jail. The petitioner is in jail custody since 09.04.2016.
Submission on behalf of the petitioner is that the present case is nothing but only a glaring example of high handedness of local police.
Patna High Court Cr.Misc. No.30282 of 2016 (2) dt.04-08-2016 Considering the aforesaid facts and circumstances as well as submissions of the parties as also taking note of the fact that the petitioner does not have any criminal antecedents, let the Petitioner, above named be released on bail on furnishing bail bonds of Rs. 5,000/- (Five Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Muffasil P.S. Case No. 168 of 2016.
