The appellants seek pre-arrest bail in connection with ABP No. 4521 of 2020 arising out of Khiri More P.S. Case No. 76 of 2020 for the offence registered under Sections 147, 341,

Patna High Court CR. APP (SJ) No.121 of 2021(2) dt.27-10-2021 2/3 323, 504 and 206 the Indian Penal Code and Sections 3(i)(r)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

Learned counsel for the appellants submits that the appellants have been falsely implicated in this case. It is further submitted that no case is made out under the provisions of the SC/ST Act because there is no allegation to abuse any member of scheduled caste or a scheduled tribe by caste name in any place within public view. It is further submitted that the appellants have no criminal antecedent.

Having heard both sides and in the facts and circumstances of the case, let the appellants, above named, in the event of their arrest/surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge (SC/ST Act), Patna in connection with ABP No. 4521 of 2020 arising out of Khiri More P.S. Case No. 76 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.

Accordingly, the appeal is allowed and the impugned order dated 05.09.2020 passed in A.B.P. No. 4521 of 2020 is
