Petitioner is in jail custody since 05.05.2016 in a case registered under Sections 420 and 409 of the IPC on the accusation that he as well as co-accused Sanjay Singh who happens to be the Chairman of concerned PACS took Rs.4,98,590/- as loan but they did not return the aforesaid amount. Submission on behalf of the petitioner is that petitioner was only member of Executive Committee and as a matter of fact the aforesaid loan was taken by co-accused Sanjay Singh and that is the reason when he filed anticipatory bail petition before the learned Sessions Judge, he agreed to deposit the amount in question. It is further submitted that petitioner has already

Patna High Court Cr.Misc. No.27465 of 2016 (3) dt.20-09-2016 2/2 deposited Rs.1,02,000/- on different dates with concerned PACS and now he is not in a position to deposit even a single farthing. It is further pointed out that the investigation has already been completed against the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Sursand P.S.Case No.05 of 2016.
