JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 5 19-08-2015 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks anticipatory bail in connection with Muffasil P.S. Case No. 75 of 2013 registered under Sections 406, 419, 420 and 120B of the Indian Penal Code. It is contended that for the same occurrence and for the same transactions two cases were lodged. The first being Kotwali P.s. Case No. 208 of 2011 on 20.08.2011 and the other being Compliant Case No. 466(C)/2011 dated 14.06.2011 which was sent under Section 156(3) Cr. P.C. pursuant to which the instant case was instituted on 7.4.2013. It is further contended

Patna High Court Cr.Misc. No.47298 of 2014 (5) dt.19-08-2015 2 / 2 that in the first case, the petitioner has already been granted anticipatory bail by a Bench of this court vide Cr. Misc. No. 39593 of 2013 on 25.02.2014.

Learned counsel for the State has opposed the prayer for bail.

Be that as it may, regard being had to the facts and circumstances of the case, in the event of arrest or surrender in the court below within a period of four weeks from today, the petitioner is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Munger in connection with Muffasil P.S. Case No. 75 of 2013 subject to the conditions as laid down under Section 438(2) Cr. P.C.
