JUSTICE SUDHIR SINGH ORAL ORDER 22-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 304/34 of the Indian Penal Code.

Allegation against the petitioner is that he was driving a tractor and his son was with him. In order to take revenge that son of informant had assaulted his (petitioner's) son, he pushed him (son of the informant) with tractor and he died on the spot. It has been submitted on behalf of the petitioner that he is in custody since 5.4.2016. Chargesheet has been submitted against the petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. Petitioner has falsely been implicated in the present case. He had no intention to hurt the child. It is further submitted that petitioner may be released after completion of nine months in custody, i.e., from 5.4.2016.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail after completion of

No.33398 of 2016 (3) dt.22-09-2016 2/2 nine months in custody, i.e., from 5.4.2016 on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, District-Gopalganj, in connection with Uchakagaon P.S. Case no. 229 of 2015.
