Having heard the parties, in my view, this court would not decide on the claim of the petitioners for grant of compensation. Indisputably land encroachment proceeding was initiated against the petitioners in which order was passed in the year 2008. No appeal was preferred there against. Whether the petitioners are in possession of the land or have right to continue in possession of the land would be a question to be raised before the appropriate authority or forum for adjudication in accordance with law.

This application is disposed of.
