This is a petition for grant of regular bail for offence under Section 394 of the Indian Penal Code. The first information report relating to offence of robbery is against unknown.
Submission of the petitioner is that the petitioner is in custody since 19.11.2015. However, he has not been put on test identification parade as yet and nothing was recovered from the possession of the petitioner and the only material is confessional statement of the co-accused. Next submission is that similarly situated co-accused, Md. Mustakim, has been allowed bail by a coordinate Bench of this Court in Cr. Misc. No. 9587 of 2016.
The learned counsel for the State opposed the prayer on the ground that the petitioner has got two
Patna High Court Cr.Misc. No.9152 of 2017 (2) dt.07-03-2017 2/2 similar type of criminal antecedent.
Considering the entire facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Naya Ram Nagar P.S. Case No. 171 of 2015 to the satisfaction of the Chief Judicial Magistrate, Munger, or successor Court.
