Petitioner seeks regular bail in connection with Benipatti P.S. Case No. 118 of 2021 , G.R. No. 930 of 2021 registered for the offence under Sections 272 / 273 / 34 of the I.P.C. and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
As per the First Information Report a Pick Up van was intercepted by the Police and a total quantity of 990 liters of Nepali Saufi wine was recovered from the same. Learned counsel for the petitioner submits that petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case with oblique
Patna High Court CR. MISC. No.49577 of 2021(2) dt.07-02-2022 2/2 motive. He further submits that the petitioner is Khalasi (helper) and the driver / Guddu Kumar Safi has been granted bail by this Court in Cr. Misc. No. 42103 / 2021. The petitioner is in custody since 7 - 6 - 2021 having no criminal antecedent and charge sheet has already been submitted.
Regard being had to the submissions made by the parties and taking into consideration the materials available on record, the fact that petitioner has got no criminal antecedent, he is in custody since 7 / 6 / 2021, charge sheet has already been submitted, similarly situated co-accused has been granted bail by this court and trial is not likely to be concluded in near future due to Covid 19 pandemic, I am inclined to grant regular bail to the petitioner.
Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge -II cum Special Judge, Excise Act, Madhubani in connection with Benipatti P.S. Case No. 118 of 2021, G.R. No. 930 of 2021. praful/- (Anil Kumar Sinha, J) U T
