JUSTICE RAKESH KUMAR ORAL ORDER 30-08-2016 Heard Mr. S. Jamil Akhtar, learned counsel for the petitioner and Sri Sada Nand Paswan, learned Special Public Prosecutor.

The sole petitioner apprehending his arrest in Imamganj P.S. Case No. 40 of 2016 registered for the offence under section 341 , 323, 504, 379 of the Indian Penal Code and Section 3 (i)(x) of the Schedule Castes & Scheduled Tribes (Prevention Of Atrocities ) Act makes a prayer for grant of anticipatory bail.

Learned counsel for the petitioner submits that on the basis of old enmity the present case was lodged against the petitioner. He further submits that before the court below compromise in between the parties has already arrived.

Patna High Court Cr.Misc. No.32040 of 2016 (2) dt.30-08-2016 2/2 Learned Special Public Prosecutor submits that on perusal of the F.I.R. offence under Section 3 of the Scheduled Castes Scheduled Tribes (Prevention of Atrocities ) Act is made out and as such in view of the provision of Section 18 of the Schedules Casts & Schedule Tribes (Prevention of Atrocities ) Act the petition is not maintainable.

I do not find it a case for grant of anticipatory bail. The petition stands dismissed.
