2. Petitioner seeks regular bail in connection with Samastiput (Muffasil) P. S. Case No. 460 of 2021 in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act.

3. As per the prosecution case, 180 liters illicit liquor was recovered from the Bolero car of the petitioner bearing Reg. No. BR-06PA-9903.

4. Learned counsel for the petitioner submits that he is innocent and has been falsely implicated in this case. No incriminating material has been recovered from conscious possession of the petitioner and he is no way connected with the

Patna High Court CR. MISC. No.38178 of 2025(2) dt.08-08-2025 2/2 aforesaid recovery. Petitioner is in custody since 26.04.2025. Petitioner claims clean antecedent. It has been further submitted that similarly situated co-accused, namely, Vikash Kumar has been granted bail by this Court in Cr. Misc. No. 29990 of 2022 vide order dated 02.09.2022.

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the aforesaid facts and circumstances of the case, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge (Excise) Court-I, Samastipur in connection with Samastiput (Muffasil) P. S. Case No. 460 of 2021.
