JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-06-2015 Heard learned counsels for the petitioner and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 149, 323 and 316 of the Indian Penal Code.
It is alleged that in the background of dispute with regard to road, the petitioners and others assaulted the brother's wife of the informant as a result of which, her 8 months pregnancy got terminated.
It is submitted by learned counsel for the petitioners that the accusation is omnibus and general against several persons and admittedly occurrence took place in the background of bona fide dispute. A statement has been made in para 3 of the petition that
Patna High Court Cr.Misc. No.25018 of 2015 (2) dt.30-06-2015 2/2 the petitioners have no criminal antecedent.
The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioners if they surrender within a period of six weeks in connection with Sugauli P.S. Case No. 269 of 2013 pending in the court of learned CJM, East Champaran, Motihari. Accordingly, the application is disposed of.
